1. Acceptance of Terms

By accessing or using hyxe.ai ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform. These terms apply to all visitors, users, and others who access or use the service.

2. Description of Service

hyxe.ai is an AI-powered influencer content generation platform. The Platform analyses your brand's website URL to extract Brand DNA and generates AI influencer personas and ad content for use in digital marketing campaigns. Access to the Platform is provided on a subscription basis.

3. Subscriptions and Billing

hyxe.ai offers subscription plans billed on a monthly basis. By subscribing, you authorise us to charge your payment method on a recurring basis. Subscriptions renew automatically unless cancelled before the renewal date.

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial billing periods unless required by applicable law.

4. Content Ownership

All AI influencer personas and ad content generated through the Platform using your brand inputs are owned by you. hyxe.ai does not claim ownership of content generated from your Brand DNA. You are responsible for ensuring that any content you generate and publish complies with applicable laws, platform policies, and disclosure requirements.

5. Acceptable Use

You agree not to use the Platform to generate content that:

• Is false, misleading, or deceptive
• Violates any applicable law or regulation
• Infringes on the intellectual property rights of any third party
• Violates platform advertising policies of Meta, TikTok, YouTube, or other distribution channels

6. FTC Disclosure

The FTC requires clear and conspicuous disclosure of AI-generated or sponsored content. You are solely responsible for ensuring your published content meets all applicable disclosure requirements. hyxe.ai provides disclosure guidance within the Platform but does not guarantee regulatory compliance for your specific use case.

7. Intellectual Property

The hyxe.ai brand, platform design, software, and all underlying technology are the intellectual property of hyxe.ai and its licensors. You may not copy, reproduce, modify, or create derivative works of any part of the Platform without prior written consent.

8. Disclaimer of Warranties

The Platform is provided "as is" without warranties of any kind, express or implied. hyxe.ai does not warrant that the Platform will be uninterrupted, error-free, or that generated content will meet your specific requirements. Use of the Platform is at your own risk.

9. Limitation of Liability

To the fullest extent permitted by law, hyxe.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of revenue, data, or business opportunities.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

11. Changes to Terms

hyxe.ai reserves the right to modify these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms. We will notify active subscribers of material changes via email.
